The attorneys of James Elliot Associate Bankruptcy and Insolvency Practice assist businesses and individuals in formulating and carrying out creative problem-solving strategies when they are faced with insolvency; either their own, or that of a customer or borrower. The Bankruptcy and Insolvency Department represents clients with diverse interests, including companies and individuals who are reorganizing, bankruptcy trustees, plan disbursing agents, lenders, landlords, and acquirers of assets from bankruptcy estates.
We have represented clients in all aspects of contested matters and adversary proceedings, including fraudulent conveyances, preferences, relief from stay motions, non-dischargeability actions, trustee motions, and the entire range of litigation matters that arise in bankruptcy cases, including appeals. In addition, we assist the firm’s insurance clients in all insolvency-related matters. The Department includes two attorneys who currently serve as a Chapter 7 Panel Trustee and have served as Chapter 11 trustees in numerous bankruptcy cases.
We regularly draw upon and benefit from the experience of the firm’s nationally recognized lawyers in Insurance Coverage and Bad Faith, Intellectual Property, Real Estate, Employment, Environmental Law, as well as other areas. This comprehensive approach to solving problems that arise in dealing with troubled businesses and individuals allows us to skillfully address these wide range of issues.
